    Default Advice, Please?

    Alright, so a quick history:
    I own a mobile home. I lived in it for 3ish years. Met someone, we moved into his house, and decided to rent out the trailer to someone. This was last summer.
    I gave her notice on March 31 (60 days) that I need to move back into the trailer on June 1, 2009. She up and left that night. Now I'm stuck with her bills from the trailer, her late fees, her mess, and she left NO oil in the tank, so my trailer is without heat at all. What can I do? I am SSOOO mad right now. Mad doesn't even begin to describe how I'm feeling.

    oh no, i am so sorry to hear that. i hope you can get some good advise. when we were landlords we just had to eat it up, and unfortunatly it happened often. i hope there is now something that you can do.

    first off don't touch anything untile you take pictures of all the damage and mess. Next keep reciepts of any money you spend to make the place livable again. Now you must file a claim in small claims court. Did she have any type of lease or was it month to month?

    Small claims court, not even sure how that works. I'm waiting to hear back from the rental tribunal, and what would I do with the credit bureau?? I'm new to this game, eh, lol

    You can sue her but it will cost you money, if the tribunal says she owes you, you can put it in the credit bureau and it will go against her credit till she pays it back(small fee to you though for putting it in).

    for her to up and leave in one night sounds like she was already planning to leave, cause it is hard to find a place in a month let alone in less the 24 hours.
    But ya all you can do is go to the tribunal and take her to tribunal court ort small claims court.. That sucks so bad. Like i told my landlord yesterday when he called we chatted for a bit he told me of the tenants in the building who are screwing him and i said, i would never ever want to be a landlord ever..to much hassles..

    I just heard back from the rental tribunal. It's apparently easier to sue her in small claims court. Now to decide whether or not the money is worth the aggravation . . .

    As for finding a place, I'm pretty sure that she moved in with her parents, because they do live close, and that's where she initially came from when she moved in.

    The guy here said it cost him like $35. But that was a while ago . . . . . I hope it's $35 not a whole lot. . . . . .

    One for the road, I didn't even see your reply. Sorry! I wasn't trying to be rude!!
    It was a month to month contract, and I am waiting for my "relief" to come to work for me so that I can go check it all out. I have to remember batteries!!!

    Small claims court isn't expensive, and you can have the costs recovered from the defendant.

    I don't know if things have changed but back when i was 19 years old I was renting an apartment and gave the husband a verbal 2 months notice. Yes i know should have done it in writting but it was my first place and I thought verbal would be good enough. Anyways i moved out on the day I told him and I guess another tenant did the same. The one tenant did not give notice and The landlord wife who owned the place was upset about it. I guess her husband did not tell her that I told him i would be moving on that date. Without going to the tribunal she went straight to the credit bureau here in town and I got a letter from the credit bureau two months later that she put me in there. I got into contact with the old landlord and had it all settled. So i am not sure but you can probably file it with the credit bureau on your own.

    Filing with the rental tribunal costs $170 if I'm not mistaken. Do you know how to find her? Here is the website for the various forms you would need (plus costs) to get your rent: http://www.ltb.gov.on.ca/en/STEL02_111286.html Small claims court is alot less. $35 sounds about right.

    Thanks everyone for your help. I just came back from checking it out. Not TTOOOO much damage, but a thorough cleaning is in order, not surprisingly. However she apparently grew an attachment to my keys, and thought that she should keep them to remind her of the good times gone. . . . . . .
    And, if I asked her to leave on June 1, and she chose to leave before the date, and hasn't returned the keys, left NO information, what can I do?? Do I clean it up, and throw her stuff out?? Do I have to wait for her to do something with it??
    Note to self: no more renting.

    if her stuff is still there and bills are still going on etc... how do you know she isn't coming back?

    Not like "living" stuff. There's garbage, and a vaccuum. And everything else is gone. Couches, tv, etc all gone.

    There's just bits of stuff. Broken chairs. Broken dishes. I really wouldn't be concerned, but the vacuum looked expensive, lol.
