    Default Question

This morning my friend and I are at the park (Bellevue) with our little boys. They want to go on the swing (baby), so we are both pushing our sons. This man is sitting on the beach. After us swing our kids for approx. 5-7 minutes he lights up a smoke. My friend asks him if he would mind moving or putting his smoke out while our kids are near him. He says NO.....he has a right to smoke, and there are no signs posted. I said but this is a public place just like a restaurant or grocery store, etc. and they don't have signs posted. He says you guys can just move then. I said I see your daughter who is about 3ish is way over there playing with your wife....do you smoke in front of your daughter? He says NO. I said then why are you smoke in front of my son? He says, you are one of those non smoker people eh?(I don't want my son exposed to smoke but I could not go there with him on that one)My friend says well I am allergric to smoke that is why...he says "oh okay then and puts it out" My question is I don't think he is allowed to smoke there is he?

yes there is no law that says you cannot smoke in public, yet. So he is allowed to smoke there. A restaurant or a grocery store are inside, this gentleman was smoking outside as he is supposed to. Although it was rude of him not to move or put it out.

I would have to say he has every right to be there unless it was posted non smoking. He was somewhat rude to not move, but sometimes idiot's will be idiots. (militant non-smoker answering this question)

I would have moved and came back later when the idiot left.

    Just my opinion though.

Oh he put it out, otherwise I would have moved but try to explain to a 20 month old "okay we have to move because the man wants to smoke here instead"LOL

This is a touchy subject for both sides...But the guy should have had some respect and moved...after all it's a kids playground area! Even if there is no sign...But then again parents who smoke around their children smoke there as well. I think that it shouldn't be done around kids at all!

I would think being outdoors with no roof over his head he was in his rights to smoke. After all it is outdoors and its not enclosed. I know its a public place but its not like a bar or restaurant. And btw I am a non-smoker. I don't know if its right or wrong, it my opinion. If it were me that was smoking and someone with kids asked me not to, I would just say O.K. and move away so it would not bother the kids.

I think it would depend on who was where first! Was he sitting and enjoying himself before you arrived? Then you should have accepted the fact he smokes outdoors and either stay ot leave. Otherwise if he came and sat after you were there then he should have moved...

I'm a non-smoker BUT, come on, its out in the so-called "fresh" air & not inside a bldg...the smoke would dissipate before 3 feet rom his mouth.

It doesn't matter who was there first. Why was he smoking on a children's playground? How come he knew it was not OK to smoke near his own kids but didn't give a rats behind about the other kids? Was there a problem with going for a short walk away from the play area and having a smoke? He knew he shouldn't be smoking in front of children. He was in the wrong.

OK I crack up everytime I think that they use to teach children that in case of a nuclear emergency they needed to go under their desks with the gas masks on.
