    More than four years after the collision that fatally injured a Sault Ste. Marie woman, Clayton Lapensee is back in court for a new trial on impaired driving charges stemming from the crash.
    The 45-year-old man's second trial in the death of Anita Proulx began Monday with the defence again challenging the admissibility of breathalyser readings taken following the Nov. 25, 2005 collision.

    I knew Anita quite well. Very very tragic. I hope he gets what he deserves, he took a wonderful women away from her husband, children and grandbabies. My wife worked with her as well at Wendy's years ago.

    IMO The whole thing is BS. To go through it all a second time is a joke and a SLAP in the face.
    This is a man who has no regrets for what he did and won't accept he was in the wrong.
    A waste of skin and tax payers money.

    I have much compassion for you Krysta and your family. With a history of DUI's, why should he even rate a trial. He chose to drink, he chose to drive. He knew he broke the law. You have intent of breaking the law. The criminal code clearly states, that if you are committing a criminal offence, and in that process someone is injured or killed, then you are guilty for having caused someone physical harm. It is BS, but I also know that it doesn't matter what they give him for a sentence, it will never be good enough to undo the harm he's done. Its too bad in this country, there is no death sentence. Because if you take a life, shouldn't your own be forfeit? If this was my mother, sister, aunt, daughter,........I think that would be the only thing that would feel like justice. As I have told my children, there are things that people do in this world, that are simply not forgivable. Again, my compassion is for you and your family.

    I wonder how this scumbag would feel if one of his family members had been killed by a drunk driver and then refused to take responsibility for his actions. I don't know how he sleeps at night. I have absolutely NO USE for people who drink and drive. It seems it is always the innocent ones who pay the price for the actions of these useless members of society. What a waste of taxpayers dollars to grant him a second trial.

    I am all for a fair trial before judgment is passed, but when it's a mere technicality that gets the person off or extended like this, it's BS. The guy still did wrong, he should still be punished, at the same time, the police that did not do the work properly ought to also get punished. Why should the family of this woman have to suffer unduly just because the cops screwed up?

    often people get mad at the judges over some of their rulings when like you say they should be mad at the cops or the crown attorneys for not doing their jobs.

    What about the people who worked at The Rosie(or Rosey), that same day. They deny everything too. He was here, but he didn't drink. There are just too many lies in this case. Bottom line, lets make a lie detector legal.

    The issue is not whether or not the police did there job properly. The issue is that this lowlife scumbag has had several DUI's and shouldn't have even been driving, and now he has taken a wonderful person away from her family and REFUSES to take responsibility for it. This piece of trash is trying to get off on a technicality. That is why I could never be a lawyer, because I could never fairly represent these low down pieces of societal trash. There is no justice in a world where drunken idiots take innocent lives, and yet they are the ones who walk away without a scratch, while another family is left to mourn. Case in point, Constable Doucet, taken away from his family at such a young age because some idiot though she was capable of getting behind the wheel.

    personally, police get a bad rap. they charge and arrest the criminals, then judges give them a slap on the wrist, so the cops have to go find him/her and arrest the same people over and over again. SO it makes sense to blame cops, for the actions of people who break the law? Why dont we just go back to blaming victims for getting raped or assaulted. The blame falls squarely on the individual who did the crime. Not on the police, and certainly never on the victim. Hell, criminals have more rights then the rest of society. God forbid we violate the rights of a criminal, therefore he/she has the right to not be held accountable, for whatever horrendous crime or wrong they did.

    IMO once you choose to drink then get behind the wheel, especially when you are not even licensed, whether you believe your sober or not you shouldn't have any rights.
    Honestly DQ this isn't the first court case I have sat through and believe me. Criminals have more rights as they can get away with everything so they get the right to keep doing it.
