    Here is the crazy part.

    The bike's owner, who is not Scott(Driver), was issued tickets totalling $1,449, including $368 for driving without due care and attention, $483 for excessive speed and $598 for having no insurance.
    How do you charge a person who is not even there? Driving without due care! he was not even on the bike. LOL Even a legal aid lawyer can beat this I would think.

    I thought anything over 50 Km/h on the posted speed limit was considered racing and has a $5000 fine + impound of the vehicle + court appearance?

    I think thats only a Ontario law and this happened in B.C. But at least we do not charge the a person who was not even there even if he owns the machine.

    The idea that a vehicle owner can be charged with speeding, though not driving, would make the car rental companies crazy.

    No way this can stand up in court. Sounds like over-zealous cops.

    Regardless, he is required to have insurance on the bike if he or anyone else, with his permission, has it on the road.

    My guess is that they issued the tickets to the bike's owner as an incentive for him to give up the name of the guy who was actually driving the bike at the time.

    British Columbia still has photo radar which makes the speeding laws apply to ensure a vehicle owner is responsible for how fast their vehicle is travelling, no matter who's behind the wheel. The owner of any vehicle can always be charged for no insurance on their vehicle no matter who is driving as well, same here in Ontario. Driver get a $5000 fine, so does the owner if not the same.

    From what I read in the past the owner of the bike is the guys mother. As for the cops laying charges it ..I believe three witnesses came forward and the cops figured they have enough evidence to lay charges.

    I don't think even in Canada they can force him to do that.

    If I tell a person who wants to use my car it has no insurance I would think he is on his own after that. No law says you must have insurance it just states you can not drive without it, and the owner was not driving.

    Owners in Ontario can be charged for allowing anybody to drive a car they own that has no insurance. The liability falls on the owner not the person borrowing the car that may or may not believe there is insurance. There is no charge for a person driving a car without insurance in Ontario if they don't own the car. The only way an owner escapes not being charged is if the car is reported to the police as stolen or taken without consent prior to the driver being caught.

    Feel free to set me straight BUT was the bike not registered to a woman? Was said woman not the drivers mother or some relative? Would that not be a plain linage of ownership to all but the most obtuse among us? He buys a bike. Insurance is too high so register the bike in Mom's name to get lower insurance and her idiot son gets to pilot the crotch rocket while you, me, and any other sane motorist gets to dodge the little puke until he wastes himself on a solid object.

    Must be different for snow machines then. We were stopped by OPP on a trail check, one guy bowered a sled with no insurance.
    The Police used a satellite phone to make sure the machine was not reported stolen, then they charged the rider for driving a uninsured sled. The police never even contacted the owner or cared what he was up to.

    They even charger one person who had insurance but did not have his insurance slip with him as proof but that charge was dropped later. From what I seen its up to the operator to make sure the machine he uses has insurance, not the owner to tell him or not.

    Sleds are a different set of laws but relatively same principals. The whole checking for insurance means he had no insurance card with him. Every driver has to show proof of insurance for the vehicle they are driving whenever they get stopped, small fine for the driver for not having the card at the road or trailside, their car or not. Owner not having insurance period is the minimum $5000 fine in court.
